Legal framework of the working day

The Law establishes a framework that regulates the working day. The Workers' Statute , and particularly its articles 34 to 38, establish various rules that delimit the possibilities of action of the employer . These are some of the most important.

The maximum length of the working day
The working day is agreed either in the collective agreement or in the employment contract. However, there is a legal limit of 40 hours per week that must be assessed over the entire year. In other words, the maximum working day can be exceeded in certain weeks, but it must be compensated in others.

The maximum daily working day is 9 hours , unless the collective agreement or, failing that, the agreement between the company and the workers' representatives provides otherwise. However, rest periods between two consecutive working days must always be respected.

The distribution of the working day
The working day may be distributed irregularly throughout the year, with weeks of longer and shorter working hours. This must be agreed in the collective agreement or through an agreement between the company and the workers' representatives.

If there is no agreement that allows the company to distribute the working day irregularly under certain conditions, it may, in any case, distribute 10% of the working day irregularly, meeting certain conditions :

The company must respect the minimum legal requirements for employee rest, both during the day and during the week.
Any extra or short hours worked must be compensated in accordance with the provisions of the collective agreement . If the agreement does not provide for this, compensation must be made in accordance with an agreement between the company and the workers' representatives. In the absence of such an agreement, compensation must be made within one year of the deviation from the normal working day.
